Client agreement terms

1. The service

Elphick Digital builds, hosts and looks after your website on the plan you choose. Work is drafted by Eddy, our AI caretaker, and checked by Jordan before anything goes live.

2. Price and payment

Setup is $0. Your first month is paid upfront when you sign up, then your plan is charged monthly in advance to the card on file. All prices are in Australian dollars. Elphick Digital is not registered for GST, so no GST is charged.

3. Minimum term and notice

There is a 12-month minimum term from your start date. After that the plan continues month to month until either of us gives 30 days' notice. Notice given during the minimum term takes effect at the end of the minimum term, or 30 days after notice, whichever is later. The final month is charged only for the days up to the end date.

4. Update Credits

One credit is one change to one existing page section: up to 150 words of copy, an image swap, or a new section built from existing blocks. A new page uses 3 credits. Launch credits are used within 60 days of your start date and never roll into monthly credits. Monthly credits roll over for up to 3 months, up to 3 times your monthly allowance. Extra credits are $89 each or 5 for $349. Always free: fixing our own mistakes, and updating your contact details or opening hours. Credits have no cash value and lapse when the plan ends.

5. Changing plans

Upgrades start straight away and the difference is charged for the rest of the billing month. Moving to a smaller plan starts at the first renewal after your minimum term. A change doesn't restart the minimum term.

6. Your site and content

Licensed while you're subscribed. Elphick Digital owns the design and code. You always keep your logo, photos, words and domain name. You may buy the site outright at any time. The buyout price is any unpaid months left in the minimum term at your current monthly price, plus an ownership fee equal to the matching one-off package price (Eddy: Launch $1,990, Super Eddy: Establish $4,490 and Eddy Max: Scale $7,990), reduced by 10% for each full year paid to no less than 50% of that price, rounded to whole dollars. We confirm the exact figure in writing before you decide. After a buyout, Eddy's monthly work stops unless you keep a plan, and you choose one of: Managed Hosting at $79/mo (no changes included; Update Credits $89 each); keep any Eddy plan at the normal full price ($129/$249/$499), without launch credits or the redesign refresh; or self-host, with a $290 handover fee.

7. Missed payments

If a payment fails we retry it after 3 and 7 days and let you know in your account. After 14 days unpaid, change requests are paused until the account is up to date.
